UDW Says IHSS Is a Budget Solution, Not a Budget Problem

En español |Sacramento, CA — The following statement was issued by Doug Moore, executive director of the 65,000-member UDW Homecare Providers Union/AFSCME Local 3930, in response to Gov. Brown’s proposed budget cuts in the In Home Supportive Services (IHSS) program:

“We are disheartened by Gov. Brown’s proposed cuts in IHSS. Californians value services for the elderly and disabled. That’s why California has been the leader nationally in home and community based care through the IHSS program. We had hoped that the governor would lead a critical discussion of what California’s long-term care system should look like in the 21st century.

“Unfortunately, the governor has proposed instead more of the same program cuts that have destabilized IHSS under the previous administration. At a time when Democrats in Washington, D.C. are trying to save health care reform and provide more opportunities for home and community based care, California is being pushed in the opposite direction.

“While we understand the severity of our state’s budget crisis, the fact is that IHSS is a budget solution, not a budget problem.  IHSS saves California taxpayers hundreds of millions of dollars a year by keeping people out of nursing homes (nursing home care costs at least five times more than IHSS home care).  It also brings billions of dollars in Federal matching funds.

And by keeping people in their communities and out of institutions, IHSS recipients and those who care for them contribute significantly to the local economy.

“Cuts in IHSS are penny wise and pound-foolish. We hope that legislators will stand up and protect the elderly and disabled of our state from this ill-conceived proposal.”

    I am a mother of a 31 year old blind/totally disabled man with cerebral palsy. he cannot do anything for himself with out assistance. he is 31 years old with the mind of a 4 year old. I worked for ihss for another patient and had my son taken care of by other staff members of ihss. when my son started getting raped by a ihss employee I took over his case as his in home provider(which I didn’t know I could work for my own son)as his mom/provider. I didn’t know that becoming my own sons provider would be costly to me because I am his mother. he has a large amount of seizures per day and I have to keep tabs on him so he don’t fall out of the wheelchair. I put him on the floor if I cant watch him at that minute because he will slap the floor with his face. he has a tendency to slap the table with his face and have large knots on his face, he hits his face on the shower door and fall down in the shower so I have to watch him while he’s showering so he don’t hit the glass. well they took protective supervision from me and refused to let me bring in a note from his Dr. the Dr had written notes in the past but they took that info out of his file and said there was no info from any Dr…(which was a lie) there is no way you can be on the program for 15 years without any medical information…so that women took all the info out of the files and told me to move out of my home( a 2 story home) and get a smaller house she said ” you don’t need this big house” SHE went to work destroying all my sons files and cut me off of protective supervision with out any Dr notices and would NOT allow me to get the proof I needed from the Dr to prove he needed protective supervision. now they are cutting me more then 30 hrs ,why…don’t know. everything in my sons life is still the same but they are telling me that since I am the mother there are things I can do without pay. wow…not because its my son…but because I was a worker for someone else in the ihss program and I wonder would they have done to my other patient who was not related to me and could not take care of himself at all. my son is worse off than this patient. if I left my son at home while I worked, he would be pissy wet all day not eat or shower and will be sitting while having seizures all day .so he really needs total care and can never be left alone . with all these cuts they are taking from my ihss check as care provider and social security check for my son. the world is making their budget cuts on the back of the totally disabled who cant help themselves and I believe the government is making money on the power programs they should cut but they are receiving money under the table to keep those programs active but since disabled people cant give the government kick backs, they (gov)cut their (disabled people’s) money .I had a stroke last month because they (government) are stressing me out! would I be getting this treatment from the gov had I not been my sons mother? would I have been able to keep my full working hours for the patient had I not been related? so all related workers will have to take major cuts to take care of there family members (in the same manner or worse) than they took care of the unrelated patient…this should be a class action for the parents of disabled children getting worse treatment and less cash for care because they left the job of unrelated clients to take on the job of a related client who needed you more. with the option of the same pay,but got cut because I’m related to my client. so the gov said I could do that for free,since I’m related . so since I am cut, I am financially destroyed by gov and don’t have a enough time to take on more work because my son needs me all day…total patient care is what my child needs. he uses pampers ,I feed ,give total hygiene care ,cook clean change his bed at least 5 to 7 times a week because he takes off his pamper and urinates in the bed…this is harder than my other patients and more mentally destroying because this is my child, but the pay now is much less…wow being a mother of a patient makes them cut me more and traps me into low income with no way out,I have to take care of this kid full time but didn’t know I would get penalized for being the parent when I traded my patient for a patient that is my own son…HELP!!! SOMEBODY START A CLASS ACTION AGAINST ARE GOV FOR TORTURING THE PARENTS OF THE CHILDREN WHO WERE THEIR EMPLOYEES FIRST THEN MADE THERE OWN CHILD THERE CLIENT…HELP!!!

    Become a advocate and empower yourself and others with this material. You do not have to be a lawyer just know the rules that IHSS and the P.A play by.
    Read every article. Of importance the letters addressed to the social, welfare or case workers.Do not be intimidated by the IHSS. It is the legal system working in your favor when you appear before a hearing officer. And if you cannot appear to the hearing because of your sons disabilities or behavior request for a fair hearing in the privacy of your home it is your/his right. When it comes to health care NEVER ACCEPT NO AS AN ANSWER. There has to be a medium ground somewhere. Good Luck and get your supervision back.

    • Here we go again. More lies. More “Forced to consider cuts” slogans, as if poor government officials, backs against the wall, have no choice. Oh, but they do. And like hardened bullies, they target the weak. After all, not many wheelchair- using-oxygen tank-toting 90-year olds, are known to overturn cars and torch a neighborhood. Slash funds for Adult Day Care Centers, advice the appointed anointed, as they sip costly coffee, around custom, dark cherry stained, hand rubbed oil finished conference tables. Partially funded by tear stained citizens they now want to rub out. No worries. “He who oppresses the poor to increase his wealth and he who gives gifts to the rich — both come to poverty.” Proverbs 22:16. So live it up ladies and gents who casually cut funds to elderly, poor and disabled citizens, because partying on the pennies of the poor won’t last forever. Cut. Cut. Cut away. Off you go to another 5 star getaway. Close your eyes now. Don’t think about the autistic adult whose having another seizure and needs nursing care. Or the once coveted physician who was struck by a train and needs help changing his diapers. And never ever think about those poor families. Fathers and mothers. Daughters and sons. Firefighters. Police officers. Marines. Teachers. Yes, they are up, crack of dawn, sometimes all night, running this rat race, to care for aging, sick or severely disabled relatives. But don’t think about now you important, important people who have your slush funds and secret agendas. Oh no, don’t think about those things, because it’s too “painful” just like it must be when you tell the public about these “painful cuts.” Cut. Cut. Cut away, for as you do, you cut your heart out with each slashing. “He who gives to the poor will lack nothing, but he who closes his eyes to them receives many curses.” Proverbs 28:27. Good luck with that Jerry and others who pretend you have “no choice.” Sure U do Jerry. And you know it.

    The Governor’s proposal to require medical certification in order to qualify or continue aid CANNOT BUT ADD TO THE BUDGET PROBLEM.

    THIS IS BECAUSE THE LAW REQUIRES THE STATE TO PAY FOR ALL SUCH EXAMINATIONS

    W & I Code sec. 12101:

    “12101. No applicant for or recipient of aid under this chapter
    shall be required to pay any part of the cost of a medical
    examination to determine blindness or disability as required by the
    department in connection with his application for or continued
    receipt of aid under this chapter.”

    400,000 MEDICAL EXAMS? Would cost in the range of $100 MILLION (@ $250 EA.)to $300 MILLION (@ $750 EA.)

    Unfortunately, the law you referenced deals with SSI/SSP – not IHSS. There is no requirement that the state pay for IHSS medical certification. Where is the specific language that shows such a requirement for IHSS?

    To Steve Campitelli, we live in Riverside county and a couple of years ago the county required my dau. doctor to fill out out a form stating that she was disabled and why. The doctor charged us $50.00 for this. This is the doctors customary charge for filling out forms other than the ins. forms. So if we have to get a dr. cert in the future I am sure that the disabled will have to pay for it.
