Legislature sends majority vote budget bills to governor by deadline

Both Houses Complete Work on 2011-2012 State Budget – Budget Plan Does Not Contain Extensions of 2009 Temporary Tax Increases – No New Additional Cuts Beyond What Was Approved in Late May and March to Health & Human Services – But On-Going Budget Deficit of Nearly $7 Billion Remains To Be Solved in 2012

 

SACRAMENTO, CALIF  (CDCAN)  [Last Updated 06/15/2011  04:20 PM] -  The California Legislature passed and sent to Governor Brown a package of bills making up the 2011-2012 State Budget passed on a majority vote without help from legislative Republicans, by the June 15th State constitutional deadline that avoided the “all cuts budget” scenario and left unresolved for now, an ongoing budget deficit next year of nearly $7 billion. 

 

The budget for 2011-2012  – when combined with the deep cuts made earlier in March – is a spending plan that Democrats say they were forced to support and Republicans say they were forced to oppose, with both sides agreeing that it does not solve the ongoing budget deficit of nearly $7 billion next year and the years beyond that remains to be solved. 

 

Still, Democrats claimed that the budget plan, while not perfect and with terrible cuts to health and human services and education, was a major step in solving the State’s dire budget crisis that began earlier in January at a $26.6 billion deficit.  That budget hole – which follows years of immense budget deficits, was closed, in part thanks to higher than expected revenues this year and projected for next year, and approval in March of massive permanent spending cuts to health, human services impacting in particular children and adults with disabilities, mental health needs, seniors, low income workers and families; K-12 education and higher education.  Other reductions were made in 2010 and 2009 impacting health and human services in particular. 

 

The final vote on the last budget related bill was taken in the Assembly at 4:17 PM.  The State Senate had completed its work about an hour earlier. 

 

Without Republican support, the revised main budget bill does not contain the Governor’s proposal to extend for five years the 2009 temporary tax increases that are set to expire June 30, 2011 – a proposal that would have required voter approval under the Governor’s plan.  Instead the budget package relies on fund shifts, one-time accounting measures, some additional cuts (but not to K-12 education or to health and human services) and some increases in fees and sales tax that legislative Democrats say does not require 2/3rds vote to approve. 

 

It was one of the few times in recent modern State history that a Legislature has met that deadline.  The deadline – nearly always ignored in the last 40 years, was beefed up this year by Proposition 25 (passed by voters last November) that allows for a budget passed by a majority vote (unless there is tax increases which requires 2/3rds vote) and imposing penalties on legislators for each day a budget is not passed and sent to the Governor after June 15th).  The State Constitution imposes that June 15th date to give a governor – and then the Legislature if any vetoes are made – to review and act on the budget bills before the start of the State budget year that begin July 1st. 

 

Bill To Eliminate Redevelopment Agencies Passes – Most Controversial Issue After the Main Budget Bill

·        The most controversial issue – after the main budget bill was passed by both houses on a majority vote earlier – that was crucial to keeping the budget plan balanced, was two bills dealing with the elimination of redevelopment agencies – and another bill that would create a new voluntary redevelopment program. 

·        The issue was contentious – nearly causing a near confrontation in the Assembly between Assemblymembers Wagner and others and only narrowly passed in the State Senate, with several Democratic senators opposing the bill or abstaining. 

·        Advocates for affordable and accessible housing that are linked to redevelopment agencies – were given assurances by Senate President Pro Tem Darrell Steinberg (Democrat – Sacramento) before the final vote was taken. 

·        Several wavering Democrats including Senators Alan Lowenthal and Loni Hancock ended up supporting the two bills based on those assurances made by Steinberg regarding redevelopment and the transition and reforms that will follow, including addressing concerns in a follow-up “fix it” legislation this year. 

 

Main Revised Budget Bill Without Tax Extensions Passed First

As reported earlier by CDCAN. the Assembly, following actions taken last week and earlier this morning by the State Senate, passed the revised main budget bill and budget related bills for the 2011-2012 State Budget year on a majority vote with no support from Assembly Republicans. 

 

All the other budget trailer bills dealing with developmental services, Adult Day Health Care, human services (including In-Home Supportive Services Public Authorities) passed without debate on majority votes. 

 

CDCAN will issue a special report later this evening or tomorrow on what the reductions and other changes cover – not only as revised in May and June – but what was passed and approved in March that impacts children and adults with disabilities, mental health needs, seniors, their families, low income families and workers, community organizations and facilities and individuals who provide supports and services.

 

Main Budget Bill Heads to Governor – Advocates Fear Line Item Vetoes

·        The main budget bills – SB 69 and AB 98 will be the first two bills headed to Governor Brown’s desk tonight – though he may take several days – if not the full 12 days he has, to review it – and use the time to try to win support for extending the 2009 temporary tax increases from certain legislative Republicans. 

·        The June 15th State constitutional deadline is for the Legislature to pass a budget plan and send it to the Governor.  The Governor has 12 days from that point to review it, sign it, use his line item veto power and then sign it – or, veto both bills entirely, which is highly unlikely. 

·        Advocates for people with disabilities and seniors especially fear a possible line item veto in the main budget bill for Adult Day Health Care, which the Legislature partially restored (half of its current funding) in order to transition and continue a new model of Adult Day Health Care under a yet to be developed federal Medicaid waiver.  Advocates also fear that the Governor could veto the individual budget trailer bill dealing with that issue – AB 96. 

·        As a result, advocates have sent out action alerts to thousands of people and families across the state urging the Governor to retain the restored funding as approved by the Legislature for Adult Day Health Care and to sign AB 96 [CDCAN has issued – and will issue another Action Alert supporting this] 

 

NEXT STEPS

·        Both the Assembly and State Senate adjourned immediately after taking their final votes on the budget bills – and both houses will reconvene in floor sessions on Thursday (June 16th) at 09:00 AM to take up action on regular bills.  Senate committee hearings scheduled for Wednesday afternoon today were cancelled due to the budget floor session and will be rescheduled.

·        The main budget bills – AB 98 and SB 69 will head to the Governor today – though he has up to 12 days to review it and then to approve it or veto it (or use his line item veto power). 

·        The budget trailer bills normally are sent to the governor several days later – because it takes time to prepare each of the bills – called “enrollment” for the governor to sign.  It can be weeks later before the Governor takes action on trailer bills (the time clock of 12 days starts when the bill actually is received by the governor – not when it is passed by the Legislature). 

·        The State budget year begins July 1st – and many of the reductions passed and approved in March will take effect then or sometime during the 2011-2012 State budget year.

AB 102 – HEALTH OMNIBUS TRAILER BILL

AB 122 – SUPPLEMENTAL APPROPRIATION BILL BUDGETG TRAILER BILL

CDCAN SUMMARY:

Would appropriate additional $1.2 billion in State general fundsfor allocation by the State Controller to the Department of Corrections and Rehabilitation ($1.15 billion), Department of Mental Health ($50 million), Department of Forestry and Fire Protection ($12.6 million), Department of Finance  ($145,000), and Mariposa, Modoc, and Shasta Counties ($1.1 million) beyond what they were budgeted in either the 2009-2010 or 2010-2011 State budget years.

PREVIOUS ACTION 06/11/2011:  PASSED State Senate 26 to 4 (Senators Anderson, Berryhill, Blakeslee and Gaines opposing).

CDCAN COMMENT:  This is known as a “deficiency bill” – meaning, allocating State general funds for those budget items or departments that for various reasons, went over their approved budgets. The money allocated is for money by these departments (and also the three counties in this bill) that has been already spent. 

There was particular concern and criticism expressed by both Sen. Mark Leno (Democrat – San Francisco) and Senate Republican Leader Bob Dutton on the overspending – due to health care costs – in the Department of Corrections and Rehabilitation, the agency that oversees the State’s prison system.

ABx1 19 – LONG TERM CARE (AB 1629 QUALITY ASSURANCE FEE EXTENSION)

ABx1 34 – RE-ESTABLISH SENIOR CITIZENS & DISABLED CITIZENS PROPERTY TAX POSTPONEMENT PROGRAM BUDGET TRAILER BILL

CDCAN SUMMARY: 

Would re-establish the Senior Citizens and Disabled Citizens Property Tax Postponement Fund within the State Treasury and annually appropriates moneys in the fund for the purposes of paying costs and disbursements related to the postponement of property taxes of eligibe senior citizens and disabled citizens.

CDCAN COMMENT:

·        The Senior Citizens and Disabled Citizens Property Tax Postponement Program (program) was created in 1997 and was, as part of the solutions to reduce the budget deficit, suspended in 2009. 

·        Under the program, the state paid the property taxes owed to the county by property owners enrolled in the program. 

·        The state placed a lien on the property for which state funding was used to pay the property taxes.  The lien was released when the property was sold or transferred and the state was repaid. 

·        To be eligible for the program, participants required to be at least 62 years old, or disabled or blind. In addition, income restrictions applied to property owner participants. 

·        For the last effective date of the program prior to its suspension, property owners with gross household incomes in excess of $35,500 were ineligible for the program.

SBx1 23 – LOCAL TAXATION AUTHORITY – COUNTIES & SCHOOL DISTRICTS – BUDGET TRAILER BILL

AUTHOR:  Senate Budget & Fiscal Review Committee

CDCAN SUMMARY: 

Would authorize counties, cities, any school district, county offices of education and community college districts to impose a local personal income tax, vehicle license fee, transactions and use tax, extractive business activities tax, oil severance tax, and excise tax, with voter approval.

LATEST ACTION 06/11/2011: PASSED by State Senate 21 to 16.
