UPDATE – 11/3/2016: According to the latest guidance from the California Department of Social Services (CDSS), wages received by Waiver Personal Care Services (WPCS) and/or In-Home Supportive Services (IHSS) providers who live in the same home as the recipient of those services are not considered part of gross income for federal income tax purposes. CDSS recently mailed the ‘Live-In Provider Self-Certification Information Notice’ and the ‘Live-In Self-Certification Form For IRS Federal Tax Wage Exclusion’ (SOC 2298) forms to providers with the same address as their IHSS client. The California Department of Social Services (CDSS) has made changes to IHSS program rules related to the 2016 implementation of overtime, travel time, and medical wait time. Some of these rules affect the way we complete our IHSS timesheets. We advise all providers to be aware of the following dates and required forms. CDSS refuses to pay IHSS providers the retroactive overtime pay we deserve

Last week, the California Department of Social Services (CDSS) announced they will not pay IHSS homecare providers retroactive overtime pay. Just last month, after a long wait, CDSS set February 1, 2016 as the implementation date for overtime pay for homecare providers. We celebrated this major and historic victory, and vowed to continue to fight for retroactive overtime pay back to October 13, 2015, the day the U.S. Department of Labor’s overtime rule went into effect.
