2011-2012 Summary of Key Legislation

The California State Legislature is currently in the middle of a 2 year (2011-2012) legislative session. Bills that have not passed out of their house of origin, or the house that they were introduced, can no longer move forward in the legislative process this session and are considered “inactive” as of January 31, 2011

SB 411 (Price) – Home Care Services Act of 2011 – Would license and impose new requirements on home care organizations. IHSS is excluded.

Status – Assembly Inactive File.

SB 930 (Evans) Would remove the fingerprinting requirement for IHSS recipients. Would remove the requirement to include spaces for provider and recipient fingerprints on provider timesheets. Would also remove the prohibitions against use of a post office box address by an IHSS provider.

AB 876 (Valadao) - This bill would restrict the right of an authorized representative of an IHSS recipient from signing their own waiver if they have a tier 2 disqualifying crime.

SB 176 (Emmerson) Would make a technical, non substantive change to an IHSS program provision.

Status Inactive (Spot bill-Never referred to Committee).

SB 33 (Simitian) Would eliminate the January 1, 2013 sunset in the Elder and Dependent Adult Financial Abuse Act set forth by SB 1018 and make permanent the mandate which requires financial institutions to report elder financial abuse to authorities.

SB 469 (Vargas) Would require that a Superstore developer bear the cost of conducting an economic and community impact analysis that the local land-use authority, such as City Council or County Board of Supervisors, would be able to refer to when considering approval of a Superstore in its jurisdiction.

AB 10 (Alejo) - Would increase the minimum wage to $8.50 per hour. Would provide for an adjustment to the hourly minimum wage on January 1, 2013, and annually thereafter, based on the California Consumer Price Index.

AB 400 (Ma) Would guarantee all California workers the right to earn paid sick days to care for themselves or a sick family member, or to take leave related to domestic violence or sexual assault.

AB 899 (Yamada) Would create minimum standards for private sector home care services. Would license and impose new requirements on home care organizations. IHSS is excluded.

The Legislation that Formed our Present IHSS System
– AB 1682 –

Assembly Bill 1682 (Honda, Villaraigosa, Shelley, Peace, Burton ) 1999 – required each county to establish an “IHSS Employer of Record” (resulting in the formation of the IHSS “Public Authorities” or PA’s) and guaranteeing IHSS home care workers in the State of California the right to collective bargaining. This bill also established that Advisory Committees/Boards be formed in each county, with consumer rights to majority representation and the right of consumers to train their own home care provider.

UDW sponsored and won enactment for this bill.
